DVC Rental Escrow Agreement

The Member certifies they will use their DVC home resort 11-month priority booking window to maintain this reservation in the Renter's name. Payment is held in escrow and released to the Member 24 hours after the check-in date, unless a valid dispute or void notice is received first. This contract is entered into in good faith for the purpose of renting reserved, one-time-use accommodations for lodging only.

1. To send the full payment to the Escrow Agent within 3 business days of signing this agreement.
2. The reservation will be in the Renter's name but the Member will always retain control of the DVC membership and booking.
3. The Renter is solely responsible for planning their stay, must follow all DVC rules, and accepts responsibility and liability for use of DVC property. No daily housekeeping is provided at DVC resorts.
4. To indemnify and hold the Disney Vacation Club Member harmless from any action taken by any guest in their party during the stay.
5. To be responsible for any unpaid charges or damages to the unit reserved in their name.
6. To waive the right to any claims against the Member for any injuries, damages, or losses sustained by the Renter or their party, except where caused directly by the Member's failure to maintain the reservation.
7. That this agreement covers lodging only. Park tickets, dining plans, transportation, and other add-ons are not included and must be arranged separately.

1. Payment is held in escrow by the designated Escrow Agent and released to the Member 24 hours after the check-in date, provided no valid dispute has been filed.
2. The Renter has 24 hours from the check-in time to file a dispute by emailing the Escrow Agent and disputes@dvcsafepay.com with proof the accommodation was unavailable — accepted proof includes: a Disney cancellation email, a DVC portal screenshot showing the reservation is gone, a written statement from the Member, or written confirmation from Disney front desk.
3. If the Member submits a written void notice to the Escrow Agent before the 24-hour release, the Renter receives a full refund. DVCSafePay.com holds no Member funds prior to the release date, so a full refund of escrowed funds is the Renter's sole platform remedy in the event of Member cancellation.
4. In the event of a dispute, DVCSafePay.com will review the evidence submitted by both parties and render a written decision within 5 business days. Both the Member and Renter agree that DVCSafePay.com's decision in any disputed matter is final and binding. Neither party may appeal the decision through DVCSafePay.com.
5. DVCSafePay.com acts solely as a payment intermediary and escrow agent. DVCSafePay.com is not liable for any damages, losses, or costs arising from the rental transaction, including but not limited to travel expenses, lost reservations, or consequential damages. The maximum liability of DVCSafePay.com to either party shall not exceed the escrow amount held for the specific transaction in question.
6. Any legal action or proceeding arising out of or related to this agreement must be filed exclusively in the state or federal courts located in Orange County, Florida. Both parties consent to the personal jurisdiction of these courts and waive any objection to venue.

The terms and conditions of this agreement are governed and interpreted pursuant to the laws of the State of Florida. Both the Renter and Member agree that any dispute under this agreement shall have venue and jurisdiction in the state or federal courts of Orange County, Orlando, Florida.
